terms of service
CONDENSED TOS
NOTICE: This is the CONDENSED version of the TOS.Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders.
Pay up front in full for orders after the sketch is approved.
Artist will NOT draw for MAGA/Trump supporters.
Artist will NOT draw for lolicons/shotacons.
Product will be delivered digitally.
Customer has right to three revisions in the sketching phase.
Customer has right to reasonable amounts of minor edits after completion (I.E eyecolor change).
Must be paid in USD on VGen, Venmo, Throne, or another service.
I, the artist, retain full and exclusive rights to the original artwork. The Customer may not claim it as their own or use it for anything other than personal use.
Refunds are NOT available.
Customer is required to contact the seller in a fast and responsive manner.
Customer can re-upload the image with credits given to myself.
Products cannot be used for commercial use without additional fees.
Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.
By ordering any suggestive or NSFW art Customer agrees that they are 18 or older.
TERMS OF SERVICE
LAST UPDATE: 1/05/24This contract applies to the artist further called Seller and person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller the Customer agrees to the following terms and conditions:PAYMENTS
1. Customer agrees to pay the due amount upfront for any orders after sketch has been seen and approved.
2. Customer accepts that work on the Product will not continue until payment has been received by Seller.PRODUCT DELIVERY
3. Customer agrees that Product will be delivered digitally to direct messages after the artwork has been completed by the Seller.
4. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.REVISIONS
5. Customer has the right to three complete revisions in the sketching phase.
6. Customer has right to a reasonable amount of minor edits after completion, such as changing an eyecolor or fixing a small detail.
7. Customer obliges to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of Customer will be recognized as implicit approval of all work progress and current state of the Product.CURRENCY CONVERSIONS
8. Customer agrees to pay the total amount specified in USD
9. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.
10. Payment is considered as received and completed only when total amount received on Seller's USD account is equal to the invoice amount in USDPERSONAL AND COMMERCIAL USE
11. The Product received by Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
12. Seller reserves every right to refuse or cancel any order, without giving reasons to Customer.
13. Any disrespectful behavior will not be tolerated and may result in a cancellation of the order. Seller will have full right to refuse any service to the Customer in the future.PROHIBITED ACTIONS
14. Altering the Sellers artwork in any way without asking for permission before hand, with the exception of cropping/resizing the image for an icon or other use.
15. Using the Sellers artwork as references for your own, whether tracing or re-purposing parts of the image.
16. Claiming the artwork as your own.If these terms are broken, Customer will be blacklisted from commissioning Seller.WORKFLOW PROCESS
17. If there are any delays in completion of a commission, Seller will personally notify Customer.
Completion of most commissions are generally estimated to take no more than roughly 1 week to a month.
18. Seller will send any wips to Customer in direct messages. Progress will be paused until the sketch is approved.
19. If you do not want Seller to post your commission online, you must tell them when you order. Vise versa, if Customer wants to post the commission, they must ask Seller for permission.This TOS was used and customized from this example and this example.

WAIT TIME: Wait time will vary from a week to a month or more (rarely) depending on my health. I am disabled so that will affect my work
